Skills Required: Giving Legal Advice and Negotiation

One of the most important skills required to be a lawyer concerns providing legal advice.  A lawyer must have the skills to be able to give advice to legal clients. A lawyer must be able to competently recommend a course of action for a client to take based on the specific facts in the client’s case and based on the applicable state law in the jurisdiction where the client lives. A lawyer must be fully competent in giving legal advice because a client will usually decide to do something or not to do something based on the lawyer’s advice in the matter. A lawyer must be able to take appropriate action in legal cases which can range from drafting a letter to drafting a legal document to trying a case in court.

A lawyer must also be able to be an effective advocate for their clients. In most cases, a legal client will want their lawyer to do something. A lawyer must be able to take the appropriate action necessary to protect a client’s rights, such as suing for damages in a personal injury case. A lawyer must also be able to provide a competent defense, such as in a criminal case so that a person on trial for a crime is ensured their constitutional rights during the trial process. A lawyer must be able to competently deal with third parties either in person or through correspondence or telephone calls.

Another skill which a lawyer needs to have is skill in negotiation. A skilled lawyer must be able to negotiate with another attorney who represents the other side in a legal case in order to reach an agreement that benefits their client. A lawyer must be skilled in recognizing when it is best to negotiate an agreement in a case in order to save the client from entering into a costly litigation. A lawyer must be able to recognize that negotiation may be possible not only prior to litigation but also during or after a trial has begun. If a lawyer is able to negotiate and reach a reasonable settlement with the other side in a case, they are usually able to save their client legal fees and are considered to be furthering the economic interests of their client.

A good lawyer needs the self-confidence early in their career which comes from mastery of certain basic legal concepts. Although new lawyers are often supervised by partners at law firms, a lawyer must be able to work independently when handling client matters with only minimal direction from senior lawyers. A lawyer must be able to project enough self-confidence to show clients and senior lawyers that they understand a variety of different legal issues.

Skills in Legal Knowledge

A lawyer must be able to take what they learned in law school classes and prior work experiences and apply this legal knowledge to assist in solving client problems. Lawyers generally work as part of a team in a law firm and they must be able to deliver excellent client services. A lawyer must be able to deliver quality work on time that shows the appropriate attention to detail. A lawyer must be able to accurately analyze the legal problems that a client has and find the best solution to the client’s legal problems. A lawyer must have skills in legal writing, legal analysis, organization, and the use of computers for legal research.

Skills in Professionalism

A lawyer must always maintain a high degree of professionalism in their work. This means that the lawyer must know how to separate emotions and personal biases from their professional dealings with clients. A lawyer must conform to appropriate styles of behavior around other people as well as conform to a style of personal appearance that is consistent with the legal profession. A lawyer with professionalism is able to set aside outside influences (such as worrying about family problems) and is able to focus solely on doing the best job possible for their clients.

A lawyer must be able to maintain their composure while dealing with all kinds of client situations. A lawyer must know how to deal with clients who are under extreme emotional stress and may be going through a life crisis, such as a divorce or separation. A lawyer must be able to represent these clients with empathy. A lawyer must be competent in building a lawyer-client relationship even when their client may be very demanding.

A lawyer must be able to maintain the strictest level of confidentiality when dealing with client matters. The lawyer-client relationship involves a client being able to tell their lawyer almost anything in complete confidence. A lawyer is not allowed to divulge confidential client information to anyone else without the client’s express permission. A lawyer must always take care to make sure that client communications are kept private by keeping close watch over communications such as private telephone messages, email messages, letters, and faxes.

Skills in Legal Analysis

A lawyer must be able to competently analyze legal materials, including legal cases and statutes. A lawyer must also be able to get facts from a client, identify the most important facts, and then apply local law to those facts in order to give their client the best possible representation. A lawyer must be able to look at a complex set of facts and then address a client’s legal problem by providing an accurate answer about how local law applies to those facts.

Skills in Computer Use

A lawyer must be able to use a computer in order to do most kinds of legal work. A lawyer must be able to use a basic word processing system in order to draft legal correspondence to clients and in order to draft legal documents such as court motions and briefs. Many courts use electronic filing systems for court documents so a lawyer must be able to use the computer to file court documents in their jurisdiction. A lawyer must be able to use a computer docketing system which contains upcoming court dates and dates for filing important court documents. A lawyer must also be able to use computerized legal research services, such as Westlaw and LEXIS. These subscription-based services allow lawyers to search easily for relevant cases in an area of law and also find statutes and law journal articles without having to go to a law library.
